Abstract

Informal discussions with various sources in the banking , legal
and in ve stm ent communitie s regarding energ y project fin ancin g con-
tinue to und erscore a critical market shift this pa st year, While ther e has
been strong int ere st in emerg ing mark ets, the regulatory, legal and con-
tractu al suppo rt mechanisms for man y infrastructure pro jects are not
necessar ily in place in a numb er of major int ern at iona l are nas , Rece nt
fiscal, c ur re ncy a nd ma rk et d evel opm ent s in Asia h a ve served to
hei ght en those conc ern s for international ener gy p roject developers at
least for the next several years.

Michael J. Zimmer, Infrastructure Deoelopment and Finance Thelell, Reid & Priest LLP (Washillgton Office

Michael J. Zimmer is a partner in the Wa shingt on , DC, office of
Thelen , Reid & Prie st. He is a cum laude grad ua te of th e Unive rsity of
Mar vland z llalt imor e Schoo l of Law in 1975 and a cum laude grad uate of
Providence Co llege, receiving his bachelor of art s d egr ee in political sci-
en ce in 1971, while also attend ing Brown Unive rsity.
Mr . Zim me r ha s rep resen ted ene rgy concerns for ove r 17 years in matters before the Department of Energ y, the FERC, and Congre ss. He
has r epresented dome stic and international indu strial and manufactur-
ing c ompanies , electric utilities and their unr egulated sub sidiaries, en-
ergy project de vel oper s, natural gas pipeline and distribution compa-
nies, trade associations, financial institution s universities and embassies.
He ha s been an invited witness on various energy and ener gy tax pro-
posal s before Con gre ssional committees, various federal d epartments
and agen cies, and stat e commissions since 1977. He has also practiced
before state public service commissions in Connecticut, Massachusetts,
New York, New Jersey, Pennsylvania, Maryland, Virginia, North Caro-
lina , Florida, Ohio, Illinois , Iowa, Missouri, New Mexico , and California.
He has energy regulatory, contracting and project finance experience in
successful support of over 12,000 MW of power generation in facilities in
25 states, and 3 foreign countries.

Samir S. Desai, Infrastructure Deoelopment and Finance Thelell, Reid & Priest LLP (Washillgton Office

Samir S. Desai is a member of the firm 's infra structur e develop-
ment and finance d epartm ent. He serves in the India, Utility Services,
Telec ommunication s and Environmental Practice Groups, and assists in
ad visin g u .s. clients seeking to invest in various markets in India on
taxation, corporate structuring and other issues. He writes regularly on
di verse sectors in India, including electricity, automobiles, telecommuni-
cations, tran sportation infra structure and oil refining. In cooperation
with Thelen, Reid & Priest affiliate, the Singhania & Compan y law firm,
Mr. Desai researches and keep s abr east of the latest lega l, financial and
re gulat or y issue s as the y ari se in India.
Mr . Desai also ad vises clients on many issu es of U'S. federal and
state ene rgy, telecommunications and environmental regulation. He as-
sisted in drafting a comprehensive, year-long review and anal ysis of
dev elopment s in the electric industry in North America during 1995-
1996.
Mr. Desai has been published in Indep endent Energv, Water, Enui-
reunient & Technol ogu; Octan e Week and Fuel Rejorniulation on India and
environmental matters.
