Abstract

Th e F ederal En erg y R egulatory Commission ("F E RC") has
h and ed in vestor-owned utiliti es a major victory in their continuing
di spu t es wit h owner s of inde pende nt electric pow er plants certified as
Qual if ying Facili ties ("QFs"). In a decision issued July 30 , 1997,
FERC upheld virt ua lly all of a New York Public Service Commission
pr ogram r equiring owne rs of QFs to provide data to their util it y cus-
tom er s t o allow the utilities to monitor their continuing compliance
with t he technical requirem ent s for QF status .

Isaac D. Benkin, Winthrop, Stimson, Putnam & Roberts

Isaac D. Benkin is a partner in the Washington, D.C., office of
Winthrop, Stimson, Putnam & Roberts. He is a former administrative
law judge at the Federal Energy Regulatory Commission. Mr. Benkin
is also an adjunct faculty member at George Washington University
Law School, where he teaches Energy Law. He is a graduate of
Harvard College and Harvard Law School.
